WORDY là nền tảng học ngôn ngữ sáng tạo cho phép người dùng học ngôn ngữ thông qua phim và chương trình truyền hình. Dịch vụ cung cấp quyền truy cập vào nội dung giáo dục từ hơn 500.000 bộ phim và series truyền hình, cho phép người dùng học ngôn ngữ một cách tương tác. WORDY hỗ trợ hơn 20 ngôn ngữ với lộ trình học tập cá nhân hóa và tính năng theo dõi tiến trình.

1. CHẤP NHẬN ĐIỀU KHOẢN

2. ĐĂNG KÝ TÀI KHOẢN

2.2. Phương Thức Đăng Ký

Bạn có thể đăng ký bằng:

  • Email và mật khẩu
  • Tài khoản Google (Google Sign-In)
  • Apple ID (Apple Sign-In)

2.3. Trách Nhiệm Tài Khoản

Bạn chịu trách nhiệm về:

  • Duy trì tính bảo mật của tài khoản
  • Mọi hoạt động xảy ra dưới tài khoản của bạn
  • Thông báo cho chúng tôi về bất kỳ việc sử dụng trái phép nào

3. DỊCH VỤ

3.1. Chúng Tôi Cung Cấp Gì

WORDY cung cấp:

  • Truy cập nội dung ngôn ngữ được tuyển chọn
  • Học từ đoạn clip phim và chương trình truyền hình
  • Tính năng lưu từ và cụm từ
  • Bài tập thực hành
  • Theo dõi tiến trình
  • Thông báo đẩy nhắc nhở học tập

3.2. Khả Năng Sẵn Có Của Dịch Vụ

Khả năng sẵn có của nội dung phụ thuộc vào:

  • Cấp độ đăng ký của bạn
  • Chất lượng kết nối internet
  • Khả năng sẵn có của dịch vụ bên thứ ba (YouTube, TMDB)

4. ĐĂNG KÝ VÀ THANH TOÁN

4.1. Các Loại Đăng Ký

WORDY cung cấp nhiều tùy chọn đăng ký:

  • Đăng Ký Hàng Tháng: Tự động gia hạn hàng tháng
  • Đăng Ký Hàng Năm: Tự động gia hạn hàng năm với mức giá ưu đãi
  • Mua Trọn Đời: Thanh toán một lần để truy cập không giới hạn
  • Dùng Thử Miễn Phí: Dành cho người dùng mới

4.2. Xử Lý Thanh Toán

Tất cả các khoản thanh toán được xử lý độc quyền thông qua Apple App Store. Giá hiện tại được hiển thị trong ứng dụng và App Store.

4.3. Tự Động Gia Hạn

Đăng ký tự động gia hạn trừ khi bị hủy. Để hủy:

  • Vào Cài đặt iOS > Apple ID > Đăng ký
  • Hủy ít nhất 24 giờ trước chu kỳ thanh toán tiếp theo
  • Quyền truy cập tiếp tục đến hết kỳ hiện tại

4.4. Chính Sách Hoàn Tiền

Tất cả các giao dịch mua qua App Store đều tuân theo chính sách hoàn tiền của Apple. Để yêu cầu hoàn tiền:

5. USER CONDUCT

5.1. Acceptable Use

You agree to use WORDY only for lawful purposes and in accordance with these Terms.

5.2. Prohibited Activities

You may not, and you may not assist, authorize, or permit any third party to:

  • Scrape, crawl, harvest, extract, mirror, cache, index, copy, or systematically retrieve any content, data, metadata, video identifier, channel identifier, subtitle, transcript, timestamp, title, translation, vocabulary item, or any other element of the Service or its underlying database, whether in whole or in part, whether substantial or insubstantial, by any means (including but not limited to manual copying, screen capture, OCR, headless browsers, automated browser extensions, mobile-app interception, MITM proxies, API clients, sniffing, packet capture, or any scripted or programmatic access)
  • Access the Service through any means other than the human-facing user interfaces officially published by WORDY for end users; without limitation, automated access, programmatic API calls outside of an official WORDY SDK released under written license, headless browsing, and any form of bot, crawler, spider, scraper, or robot are strictly prohibited
  • Reverse engineer, decompile, disassemble, deobfuscate, tamper with, or attempt to derive the source code, models, prompts, embeddings, or algorithms of the Service, including the mobile applications, the web application, the Chrome extension, and any backend API, except to the extent that such reverse engineering is expressly permitted by mandatory applicable law (and in such case only after providing WORDY at least 30 days' prior written notice and an opportunity to provide the requested interoperability information)
  • Circumvent, disable, or interfere with any authentication, rate-limiting, anti-abuse, fingerprinting, integrity-verification, telemetry, watermarking, canary, honeypot, or access-control mechanism of the Service, or use multiple accounts, disposable accounts, rotating IP addresses, residential proxies, or any other technique to evade such mechanisms
  • Use the Service or any data extracted from it to train, fine-tune, evaluate, benchmark, distill, or otherwise develop any machine-learning model, language model, dataset, embedding, or any competing product or service; without limitation, this is an express, explicit, and machine-readable opt-out under Article 4(3) of Directive (EU) 2019/790 (the DSM Directive) and any equivalent national implementations, including Hungarian Szjt §35/A–§35/B, and applies to all reservations of rights under Article 53 of Regulation (EU) 2024/1689 (the AI Act)
  • Use, copy, reproduce, distribute, re-utilize, communicate, make available, or sublicense any substantial part, evaluated qualitatively or quantitatively, of the database underlying the Service, including any compilation, selection, or arrangement of video identifiers, channels, subtitles, transcripts, timestamps, translations, titles, or learning content; the database is protected by the sui generis right of Article 7 of Directive 96/9/EC and Hungarian Szjt §§84/A–84/E, of which Appalex Kft. is the maker and rightholder
  • Engage in the repeated and systematic extraction or re-utilization of insubstantial parts of the database which conflicts with normal exploitation of the Service or unreasonably prejudices the legitimate interests of Appalex Kft., as defined in Article 7(5) of Directive 96/9/EC and Hungarian Szjt §84/B(2)
  • Build, operate, distribute, market, or commercialize any competing or substitutive product or service that uses, incorporates, derives from, or is in any way based on content, data, methodology, prompts, models, or infrastructure of the Service, or that constitutes parasitic copying within the meaning of Article 55(1)(c)(3) of Turkish Commercial Code (TTK Law No. 6102), Hungarian Tpvt §2, or analogous unfair-competition rules in any jurisdiction
  • Use the Service for any commercial purpose other than personal language learning, except under a separately negotiated written commercial license signed by an authorized representative of Appalex Kft.
  • Collect, harvest, or aggregate personal data of other users, public-figure data, or any data identifiable to natural persons through the Service
  • Distribute spam, malware, phishing content, or any content that infringes any third-party right or violates any applicable law
  • Interfere with, disrupt, or impose an unreasonable load on the Service, its servers, or its network, including denial-of-service attacks, resource exhaustion, or excessive request rates
  • Violate any intellectual property right, trade-secret right, database right, or unfair-competition right of Appalex Kft. or any third party, in any jurisdiction

5.2.1. Specific Anti-Scraping Notice (Mandatory Reading)

Appalex Kft. invests substantial human, editorial, technical, and financial resources in obtaining, verifying, and presenting the WORDY database, including but not limited to: (i) curating and licensing video sources; (ii) generating and human-verifying subtitle transcriptions using OpenAI Whisper combined with proprietary post-processing; (iii) producing localized titles using proprietary LLM pipelines and editorial review; (iv) maintaining indexing, scoring, and difficulty-grading systems; and (v) operating distribution and synchronization infrastructure. This database is protected as a sui generis database under Article 7 of Directive 96/9/EC and Hungarian Szjt §§84/A–84/E. By accessing the Service, you irrevocably acknowledge and agree that:

  • Any scraping, crawling, automated extraction, programmatic access, mirroring, or re-utilization of any part of the Service or its database, whether qualitatively or quantitatively substantial or insubstantial, repeated or one-time, is a material breach of these Terms and an infringement of the sui generis database right, copyright, trade-secret rights, and unfair-competition rights of Appalex Kft.
  • The Service's API endpoints, JWT-authenticated routes, and mobile/web/extension client interfaces are not public or open APIs and are not licensed for third-party use; authentication via the standard signup flow grants you a personal, non-transferable, non-sublicensable, revocable license to access the Service through official WORDY clients only, for personal language-learning purposes only
  • Any technological measure used by Appalex Kft. to control access (including JWT authentication, rate limits, request signatures, device fingerprinting, and any future access-control mechanism) is a 'technological protection measure' within the meaning of Article 6 of Directive 2001/29/EC and Hungarian Szjt §95; circumvention is independently actionable
  • This clause is an express, machine-readable rightholder reservation against text-and-data mining under Article 4(3) of Directive (EU) 2019/790 and an express opt-out from any training, fine-tuning, evaluation, distillation, or benchmarking of any AI system using the Service or its outputs, including but not limited to large language models, transcription models, translation models, and recommender systems
  • Each unauthorized access to the API, each unauthorized request, each unauthorized record extracted, and each unauthorized record re-utilized is a separate breach for the purposes of calculating damages, costs, and equitable relief
  • If you breach this Section 5.2.1, you irrevocably consent to liquidated damages of EUR 5 per unauthorized API request and EUR 0.50 per record extracted or re-utilized, as a reasonable pre-estimate of the loss suffered by Appalex Kft. in the obtaining, verification, and presentation of its database, without prejudice to actual damages, profits-disgorgement, lost-profit damages, hypothetical-license damages, or any other remedy available under EU, Hungarian, Turkish, US, or applicable law
  • You consent to the exclusive jurisdiction of the Budapest-Capital Regional Court (Fővárosi Törvényszék) for any dispute arising out of unauthorized automated access, scraping, or extraction, with Hungarian law (including Szjt, Tpvt, Polgári Törvénykönyv) and EU law applicable; this jurisdiction clause is mandatory and exclusive notwithstanding any other forum-selection provision
  • You agree that Appalex Kft. is entitled to interim and final injunctive relief, takedown notices to app stores (including Apple App Store and Google Play), and any other equitable remedy, without need to demonstrate further irreparable harm, in addition to monetary damages

This clause is intended to (a) clearly and unambiguously prohibit unauthorized automated access; (b) constitute a 'reasonable step under the circumstances' to keep the underlying methodology and database secret within the meaning of Article 2(1)(c) of Directive (EU) 2016/943 and Hungarian Act LIV of 2018 on the Protection of Trade Secrets; (c) operate as an express, machine-readable rightholder reservation against text-and-data mining under Article 4(3) of Directive (EU) 2019/790; and (d) defeat any defense based on the absence of explicit contractual prohibition under Meta Platforms, Inc. v. Bright Data Ltd., hiQ Labs, Inc. v. LinkedIn Corp., or Van Buren v. United States, by establishing clear, conspicuous, surviving contractual restrictions on automated access.

5.3. Community Guidelines

If we introduce community features, you must:

  • Not share others' personal information
  • Not post offensive, obscene, or discriminatory content
  • Not engage in political or religious propaganda
  • Respect moderator decisions

5.4. Account Suspension

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in illegal activities
  • Harm the Service or other users
  • Provide false information

6. INTELLECTUAL PROPERTY

6.1. WORDY Content and Database

All content, features, functionality, source code, models, prompts, embeddings, schemas, methodology, design, user interfaces, branding, trademarks, and trade dress of WORDY are exclusively owned by Appalex Kft. (or its licensors) and are protected by copyright, trademark, database, trade-secret, unfair-competition, and all other intellectual-property laws of Hungary, the European Union, and all other applicable jurisdictions. Nothing in these Terms transfers, licenses (except as expressly stated), assigns, or otherwise grants you any ownership in or to the foregoing.

6.2. Sui Generis Database Right

Appalex Kft. is the maker of the WORDY database within the meaning of Article 7 of Directive 96/9/EC and Hungarian Szjt §§84/A–84/E, and has made qualitatively and quantitatively substantial investment in the obtaining, verification, and presentation of the database, including but not limited to: licensing and curation of video sources; transcription and human verification of subtitles using proprietary pipelines built on OpenAI Whisper and other foundation models; localization of titles, descriptions, and learning content using proprietary LLM pipelines and editorial review; difficulty grading, vocabulary scoring, and learning-path engineering; and ongoing maintenance, refresh, deletion, and addition of records constituting a substantial new investment for the purposes of Article 10(3) of Directive 96/9/EC and Szjt §84/D. As the database maker, Appalex Kft. has the exclusive right to prevent extraction and re-utilization of the whole or any qualitatively or quantitatively substantial part of the database, and to prevent the repeated and systematic extraction or re-utilization of insubstantial parts which conflicts with normal exploitation of the database or unreasonably prejudices the legitimate interests of Appalex Kft. The sui generis right is independent of, and additional to, any copyright in any individual element of the database.

6.3. Trade Secrets

The WORDY methodology, including its proprietary LLM prompt engineering, transcription post-processing, editorial selection criteria, difficulty-grading algorithms, recommender systems, training data, evaluation datasets, internal benchmarks, and database schemas, constitutes a trade secret within the meaning of Article 2(1) of Directive (EU) 2016/943 and Hungarian Act LIV of 2018. Appalex Kft. takes reasonable steps to keep this information secret, including by (i) restricting access via authentication; (ii) the prohibitions of these Terms; (iii) confidentiality obligations on employees and contractors; and (iv) the technological measures referenced in Sections 5.2 and 5.2.1.

6.4. Third-Party Content

Movies, TV shows, music videos, and other underlying media content remain the property of their respective owners. WORDY provides access to this content within the Service solely for personal, non-commercial, educational language-learning purposes. No part of the third-party content may be downloaded, copied, redistributed, mirrored, scraped, or used in any way outside the Service or for any purpose other than personal language learning within the official WORDY clients.

6.5. User Content

You retain ownership of content you create within the Service (saved words, notes, custom collections). You grant Appalex Kft. a worldwide, non-exclusive, royalty-free license to store, sync, host, display, and process this content as necessary to provide the Service to you.

6.6. Restrictions

Without limiting the prohibitions in Sections 5.2 and 5.2.1, you may not, and you may not assist any third party to:

  • Copy, modify, distribute, communicate to the public, make available, mirror, cache, or create derivative works of any content of the Service or any part of the WORDY database, in any medium and by any means, including for the purpose of training, fine-tuning, evaluating, distilling, or benchmarking any machine-learning model or AI system
  • Extract or re-utilize any qualitatively or quantitatively substantial part of the WORDY database, or engage in repeated and systematic extraction or re-utilization of insubstantial parts
  • Download, copy, screen-record, or redistribute third-party content obtained through the Service outside the official WORDY clients
  • Use any content, data, methodology, prompt, model output, or vocabulary list of WORDY for any commercial purpose, including building or operating any product, service, dataset, model, or feature that competes with or substitutes for WORDY
  • Remove, alter, or obscure any copyright, trademark, attribution, or proprietary notice on the Service
  • Use the WORDY name, logo, trademarks, trade dress, or distinctive presentation in a manner that would create a likelihood of confusion, association, or sponsorship
  • Engage in any act that constitutes parasitic copying, slavish imitation, or unfair imitation within the meaning of Article 55(1)(c) of Turkish Commercial Code (TTK Law No. 6102), Hungarian Tpvt §§2 and 6, or any analogous unfair-competition rule in any jurisdiction

  • Sự kiện bất khả kháng
  • Vấn đề tương thích thiết bị

7.2. Độ Chính Xác Của Nội Dung

Mặc dù chúng tôi nỗ lực đảm bảo độ chính xác, chúng tôi không đảm bảo rằng tất cả nội dung đều không có lỗi hoặc phù hợp với mọi mục đích học tập.

7.3. Giới Hạn Trách Nhiệm Pháp Lý

Trong phạm vi tối đa được pháp luật cho phép, trách nhiệm của chúng tôi được giới hạn ở số tiền bạn đã trả cho Dịch Vụ trong 12 tháng trước khiếu nại.

8. QUYỀN RIÊNG TƯ VÀ BẢO VỆ DỮ LIỆU

Việc bạn sử dụng WORDY cũng được điều chỉnh bởi Chính Sách Bảo Mật của chúng tôi, trong đó giải thích cách chúng tôi thu thập, sử dụng và bảo vệ thông tin của bạn. Bằng cách sử dụng WORDY, bạn đồng ý với các thực hành dữ liệu của chúng tôi như được mô tả trong Chính Sách Bảo Mật.

9. SỬA ĐỔI DỊCH VỤ VÀ ĐIỀU KHOẢN

9.1. Thay Đổi Dịch Vụ

Chúng tôi có thể:

  • Thêm tính năng mới
  • Sửa đổi các tính năng hiện có
  • Xóa các tính năng lỗi thời
  • Thay đổi tính khả dụng của nội dung

Chúng tôi sẽ thông báo cho bạn về các thay đổi quan trọng trước 30 ngày.

9.2. Cập Nhật Điều Khoản

Chúng tôi có thể cập nhật các Điều Khoản này theo thời gian. Chúng tôi sẽ thông báo cho bạn về các thay đổi quan trọng qua:

  • Thông báo trong ứng dụng
  • Email
  • Thông báo trên trang web

Việc tiếp tục sử dụng sau các thay đổi đồng nghĩa với việc chấp nhận.

10. KHẢ NĂNG TIẾP CẬN

Chúng tôi cam kết làm cho WORDY có thể tiếp cận được với tất cả người dùng. Chúng tôi liên tục nỗ lực hướng tới việc tuân thủ WCAG 2.1 AA. Báo cáo các vấn đề về khả năng tiếp cận đến: support@appalex.hu

11. CƠ SỞ GIÁO DỤC

11.1. Tài Khoản Tổ Chức

Các cơ sở giáo dục có thể ký kết các thỏa thuận đặc biệt với:

  • Chiết khấu theo số lượng
  • Tài khoản nhóm
  • Tính năng giám sát của giáo viên
  • Công cụ báo cáo tiến trình

11.2. Bảo Vệ Học Sinh

Tài khoản học sinh tự động có:

  • Cài đặt quyền riêng tư nâng cao
  • Tính năng cộng đồng hạn chế
  • Yêu cầu phê duyệt của giáo viên đối với một số tính năng nhất định

12. GIẢI QUYẾT TRANH CHẤP

12.1. Giải Quyết Không Chính Thức

Chúng tôi ưu tiên giải quyết tranh chấp một cách không chính thức. Liên hệ với chúng tôi tại support@appalex.hu để thảo luận về bất kỳ vấn đề nào.

12.2. Trọng Tài

Đối với người dùng EU: Tranh chấp có thể được đệ trình lên cơ quan giải quyết tranh chấp tiêu dùng địa phương của bạn hoặc nền tảng Giải quyết Tranh chấp Trực tuyến Châu Âu tại: https://ec.europa.eu/consumers/odr/

Đối với người dùng Mỹ: Tranh chấp sẽ được giải quyết thông qua trọng tài ràng buộc theo các quy tắc của Hiệp hội Trọng tài Mỹ, trừ trường hợp pháp luật có quy định khác.

12.3. Luật Áp Dụng

Các Điều Khoản này được điều chỉnh bởi luật pháp Hungary, không tính đến các quy định xung đột pháp luật. Việc lựa chọn luật áp dụng này không ngăn bạn dựa vào các luật bảo vệ người tiêu dùng bắt buộc tại quốc gia cư trú của bạn.

12.4. Thẩm Quyền Xét Xử

Đối với các tranh chấp không thể giải quyết thông qua giải quyết tranh chấp thay thế, tòa án Budapest, Hungary sẽ có thẩm quyền xét xử, tuân theo các luật bảo vệ người tiêu dùng áp dụng có thể cho phép bạn khởi kiện tại quốc gia cư trú của mình.

13. CÁC ĐIỀU KHOẢN KHÁC

13.1. Toàn Bộ Thỏa Thuận

Các Điều Khoản này và Chính Sách Bảo Mật của chúng tôi cấu thành toàn bộ thỏa thuận giữa bạn và Appalex Limited liên quan đến WORDY.

13.2. Tính Tách Biệt Của Các Điều Khoản

Nếu bất kỳ điều khoản nào trong các Điều Khoản này được phát hiện là không thể thi hành, các điều khoản còn lại sẽ tiếp tục có hiệu lực.

13.3. Không Có Sự Từ Bỏ

Việc chúng tôi không thực thi bất kỳ quyền hay điều khoản nào không có nghĩa là từ bỏ quyền hoặc điều khoản đó.

13.4. Chuyển Nhượng

Bạn không được chuyển nhượng các Điều Khoản này mà không có sự đồng ý của chúng tôi. Chúng tôi có thể chuyển nhượng quyền và nghĩa vụ của mình mà không bị hạn chế.
